• Provide medical diagnosis, treatment, or prescriptions
• Replace professional medical advice from a licensed healthcare provider
• Guarantee accuracy or completeness of health information
• Monitor your health in real-time or provide emergency alerts

You are solely responsible for your healthcare decisions. Always consult with a qualified healthcare provider before making medical decisions. In case of emergency, call 911 or contact your local emergency services immediately.

4. AI Assistant Limitations

Our AI assistant provides general health information based on keywords and context. You acknowledge that:

• AI responses are NOT personalized medical advice
• AI may not consider your complete medical history or individual factors
• Always verify AI-provided information with your healthcare provider
• Critical health decisions should be made with professional medical guidance

5. User Responsibilities

All content, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio) are owned by CareTrack, its licensors, or other providers of such material and are protected by copyright and other intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: CareTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Use or inability to use the Service
• Unauthorized access to or alteration of your data
• Statements or conduct of third parties
• Any other matter relating to the Service

Even if CareTrack has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless CareTrack, its officers, directors, employees, and agents from any and all claims, damages, and costs (including attorney's fees) arising from your use of the Service or violation of these Terms of Service.

CareTrack complies with the Health Insurance Portability and Accountability Act (HIPAA) regulations for protected health information. Our Business Associate Agreements with third-party providers ensure your PHI is safeguarded appropriately.

14. Governing Law

These Terms of Service and any separate agreements we provide are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms of Service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, rather than in court.

16. Modifications to Terms

CareTrack may modify these Terms of Service at any time by updating this page. Your continued use of the Service following changes constitutes acceptance of the modified terms.

17. Entire Agreement

These Terms of Service and our Privacy Policy constitute the entire agreement between you and CareTrack regarding your use of the Service and supersede all prior and contemporaneous agreements.
